Our terms & conditions
Acceptance of the quotation ( fixed cost ) or estimate ( costing where certain items are to be conformed ) means that the client has read and accepted the terms and conditions set out below. Any queries should be clarified before beginning works.

Overview:
​
Before beginning any landscape project, we try and make everything as clear as possible so there are no surprises for you. We try our best to make sure that we clarify everything including costs, timeframes & materials before a job has begun to avoid disappointment down the line. If we have different ideas on what is happening half way through a project, this makes everything much more complicated both for us & the customer. We have written our terms and conditions taking both ours and the clients best interests into consideration. There are very rarely any problems but below are some things to keep in mind.

Costs & payment terms:

Landscaping projects:
​
If a job is below the value of £2500, payment will be due 7 days after the works are completed. For jobs between the value of £2500 and £10,000, we ask that a 25% payment is completed at the end of the first day. For jobs which are worth between £10,000 and £50,000 we ask that a 25% payment is completed at the end of the first day & an additional 25% is due halfway through the project. A director will have the final call as to what they believe is half way through a project. This is not for the customer to decide. For jobs which exceed £50,000, the payment terms will be agreed before the acceptance of the contract.

Regular maintenance:
​
Regular garden / grounds maintenance is typically charged monthly for domestic customers & quarterly for commercial customers. This payment is due 7 days after the invoice is sent for domestic & 30 for commercial work.
Landscape design:
For landscape design services, we take an upfront fee of 50% & then the remaining amount after the design has been completed.

​Domestic payment terms:
After a project is completed we expect the remaining balance to be paid within 7 days. If you have any problems with payment let us know as soon as possible. For domestic work if you fail to pay within 14 days a late payment fee of 5% shall be added to the remaining balance total. If the failure to pay continues, a 5% interest fee shall be added on every month after 46 days of failure to pay. ( 14 days + 30 day 5% late fee ) For commercial works the final payment is due within 30 days unless a contract states different before beginning works or is discussed with a director before.

Payment types:

Payment can be made via bank transfer or cash, We DO NO LONGER accept CHEQUE payments.

Electric & Water:
​
For domestic works, water & electricity access is ideally required for landscaping projects including patios, brickwork, demolition & fencing. If you do not have any of the following please let us know before we begin works so we are able to sort it. We are able to provide hoses and extension leads.

Contract:
​
All contracts must be agreed in writing or via an online signature form to ensure that the contact is legally binding. You will also be sent a copy of terms and conditions to sign after the acceptance of our quote. This is all saved on our system but is private and will be deleted 30 days after payment.

Additional works:
​
A charge will be made for any additional works carried out, on instruction from the Client, and not specified in the Contract. Additional labour will be charged by the hour. Standard hourly rate for our landscapers are £25 / hour unless a director says different. All costs are subject to Vat @ the current rate. Additional materials shall be quoted for and agreed to, before these added works are undertaken.

Access to site:
​
​We politely ask that the Client ensures there is adequate access to the Site e.g. that all vehicles and other obstacles are removed, that gates, doorways and passageways are clear of obstruction and unlocked, that neighbours are notified where access is required to carry out the work. We also request that all dog mess be cleared from the Site, if the works cannot be carried out the team will leave the site and you may still be charged a small fee of up to £100.

Sub surface hazards:
​
The client should inform a member of South West Landscaping regarding any springs, flooding, rock, mine workings, covered wells, or other cavities, running sand, service pipes and cables, sewage or land drains, foundations and sub-structures of former buildings or other hazards or obstructions except those which are reasonably apparent by inspection of the site prior to the date of the Contract. South West Landscaping will asses the site before any works commence but cannot be liable for any sub surface issues should they arise. Should additional work arise due to unknown or hidden structures as listed above, we may be required to add additional labour or extend the project timeline. In some cases we might have to factor in extra costs for materials needed to fix the issue eg: pipe, drains. In the event this does happen, all costs will be discussed with the client prior to the work commencing. This very rarely happens but we ask you to do your best to let us know of any hazards before hand. Pipes & soak aways can often be found on your house blueprints / plans.

Planning permissions, TPO's & Local authority:
​
The Client needs to ensure they have obtained all permissions, given all notices and paid all fees required under any regulation or by law of any local authority/statutory undertaker/other authority having any jurisdiction with regard to the Works unless a request has been made to South west Landscaping Ltd to carry this out on your/the client’s behalf. You/the Client shall indemnify South West Landscaping Ltd against any claim/proceedings/loss or expense resulting from you/the Client failing to gain permissions/give notices/pay fees required in whole or in part. South West Landscaping will agree with the client, where appropriate, permissions that they will seek on behalf of the Client.

Materials:
​
South West Landscaping shall have lien on all goods and materials remaining on site until full payment of all monies have been made. The company shall have free access to enter the site to remove such goods and materials.

Subcontractors:
​
As a growing company we do use subcontractors during busy periods or when additional expertise is required to complete a job. South West Landscaping Ltd works closely with these external companies & takes responsibility for all actions and work carried out on our sites. If you have any complaints let us know as soon as possible and we will work with our subcontractors to resolve these.

Complaints:
​
Any concerns or complaints regarding works must be made no longer than 7 days after the completion of works. Our team will work with you to sort these out as soon as possible.

​Planting and turfing:
Separate watering and plant/turf care guides are sent to you/the Client on completion of The Works. It is the responsibility of the Client to carry out this care in accordance with these guides and no responsibility for plants and turf will be taken by South West Landscaping once the Works have been completed. The plants we use have no specific guarantee from our suppliers once they leave their nurseries.

Quotes:
​
Quotes are only valid up to 60 days after visiting your property unless stated differently. We will normally send a quote via WhatsApp, email or phone number & if accepted a formal quote sheet will be sent to your email as well as a link to sign and agree to our terms and conditions.
